No Win No Fee agreements were introduced in order to create better access to justice for victims of negligence.
Under a No Win No Fee agreement, you will not be responsible for your Lawyer’s fees if your claim us not successful.
If you are successful your Lawyer's fees will be recovered from the Defendant.
It is important to note, No Win No Fee agreements cannot cover you for your liability for the Defendant’s costs of successfully defending your claim. That is, if you loose your case, and have issued Court Proceedings, you will be responsible for the Defendant’s costs.
However, in order to counter this risk, your Lawyer will (and has a professional duty to) obtain insurance to cover you. This insurance runs along side your No Win No Fee agreement and the premium is deferred until the end of the case. The cost of the insurance is recoverable from the Defendant if you succeed in your claim. If you are unsuccessful, the policy insures the premium. You will not therefore have to pay anything towards the insurance.
No Win No Fee agreements do not cover the cost of disbursements that arise in your case, such as the cost of medical reports or medical records. You may be asked to fund these as they arise. They are recoverable from the Defendant if you win. If you loose and have taken out insurance, you will be reimbursed.
